Terms and Conditions

Article 1 – INTRODUCTION

This User Agreement (“Agreement”) governs the terms and conditions of the services provided by Mithrapack Ambalaj İhracat İthalat Limited Şirketi (“Mithrapack”) on the website www.mithrapack.com.tr (“Website”). All policies and rules related to the Website constitute an integral part of this Agreement and are deemed annexes hereto.

Article 2 – PARTIES

A) Mithrapack, registered with the Istanbul Trade Registry under registration number ***** and having its registered address at Orhan Gazi Mah. 1646. Sk. 3 Etap Kiptaş Başak Konutları C10 Blok No: 7/29, Inner Door No: 3, Esenyurt / Istanbul.

B) Any natural or legal person who becomes a member of or uses the Website with or without membership (“User”).

Article 3 – SUBJECT OF THE AGREEMENT

This Agreement has been prepared to determine the terms and conditions under which the User may benefit from the Website owned by Mithrapack.

Article 4 – RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The User agrees to act in compliance with all applicable laws while using the Website, not to engage in any conduct contrary to public morality or public order, not to infringe upon the intellectual and industrial property rights of others, and not to obstruct or complicate other users’ access to or use of the services.

4.2. The User undertakes to use the password provided to or created by them personally and not to share it with third parties.

4.3. The User declares and undertakes that all personal and other information provided during registration is accurate and complete.

4.4. The User agrees not to access other users’ data without authorization.

4.5. In the event of a breach of this Agreement, all legal and criminal liability arising from such breach shall belong solely to the User, and the User shall hold Mithrapack harmless from any such liability. Mithrapack reserves the right to claim compensation for any damages incurred.

4.6. Mithrapack reserves the right to unilaterally terminate the User’s membership and delete related data. In such cases, Mithrapack shall bear no liability. 4.7. The software development and design of the Website belong to Mithrapack, and all intellectual and industrial property rights are protected by law. The User may not infringe upon, use, or modify these rights.

4.8. Mithrapack reserves the right to monitor and record log records related to the User’s activities on the Website in accordance with legal obligations.

4.9. Mithrapack processes the User’s personal data in accordance with Law No. 6698 on the Protection of Personal Data (KVKK). The Privacy Policy is accessible via the Privacy Policy page.

4.10. Although Mithrapack has taken security measures, the User acknowledges that they are responsible for their own software security and for providing virus protection systems. Mithrapack shall not be liable for any damages arising otherwise.

4.11. Mithrapack shall not be liable for unauthorized access to the User’s personal data or for software/data damages. The User agrees not to claim compensation from Mithrapack for any damages arising from the use of the Website.

4.12. Mithrapack reserves the right to modify the Website content, terminate services, or delete user information at any time.

4.13. Mithrapack reserves the right to amend or cancel the terms of this Agreement without prior notice.

4.14. The parties agree that Mithrapack’s legal books and computer records shall constitute the sole and conclusive evidence and shall be deemed valid evidence pursuant to Article 193 of the Turkish Code of Civil Procedure No. 6100.

Article 5 – INTELLECTUAL PROPERTY

All content on the Website, including logos, designs, texts, HTML, CSS, JS, and PHP codes, as well as industrial designs, are subject to Mithrapack’s intellectual and industrial property rights. The User may not use, reproduce, distribute, or modify these rights.

Article 6 – TERMINATION

This Agreement shall remain in force unless the User cancels their membership. In the event that the User violates the provisions of this Agreement, Mithrapack shall have the right to unilaterally terminate the Agreement without any obligation to pay compensation.

Article 7 – SETTLEMENT OF DISPUTES

Any disputes arising out of or in connection with this Agreement shall be subject to the jurisdiction of the Istanbul (Küçükçekmece) Courts and Enforcement Offices.

By visiting the Website and/or creating a membership on the Website, the User shall be deemed to have read and understood all provisions of this Agreement, which shall enter into force upon electronic approval.
